The Municipalities Act [section 53 and 61]

________________________

TO INCORPORATE THE ORGANIZED HAMLET OF INDIAN POINT – GOLDEN SANDS AND THE ORGANIZED HAMLET OF TURTLE LAKE LODGE

AS THE RESORT VILLAGE OF TURTLE VIEWPursuant to section 53 of The Municipalities Act, the Organized Hamlet of Indian Point – Golden Sands

and the Organized Hamlet of Turtle Lake Lodge have jointly applied to incorporate as the Resort Village of Turtle View.

It is deemed appropriate and in the public interest to incorporate a new resort village. The undersigned, therefore, issues an Order pursuant to section 61 of The Municipalities Act.



IT IS HEREBY ORDERED THAT:

1 The areas described as follows be withdrawn from the Rural Municipality of Parkdale No. 498 and be incorporated as the Resort Village of Turtle View:

(a) the Organized Hamlet of Indian Point – Golden Sands, being that area described in an Order dated October 22, 1985;

(b) the Organized Hamlet of Turtle Lake Lodge, being that area described in an Order dated May 2, 2013;

(c) Township 53, Range 18:

(i) LSD 5 in Section 22, described as Block A, Plan No. 101660824, Ext. 33;

(ii) the road allowance between the north-east and south-east quarters of Section 21 described on Plan No. 00B10509;

(iii) the road allowance and road widening Plan No. 86B08505 lying west of the south-west quarter of Section 27, west of Section 22, through Section 16, through and west of Section 9;

(iv) the road allowance and road widening Plan No. 76B02742 lying west of Section 4;

(d) Township 52, Range 18:

(i) the road allowance and road widening Plan No. 76B02742 lying west of Sections 33 and 28;

(ii) the road allowance and road widening Plan No. 89B10872 lying north of Sections 19 and 20;

All West of the Third Meridian.

2 The Organized Hamlet of Indian Point – Golden Sands and the Organized Hamlet of Turtle Lake Lodge will each cease to be designated as organized hamlets as of 11:59:59 p.m. on December 31, 2019.

3 The boundaries of the new municipality of the Resort Village of Turtle View shall comprise the territory in the Province of Saskatchewan, as described and shown in Appendix A.

IT IS FURTHER ORDERED THAT:

4 The terms and conditions of the original restructuring agreement entered into by the Rural Municipality of Parkdale No. 498 and the Organized Hamlet of Turtle Lake Lodge and the Organized Hamlet of Indian Point – Golden Sands are approved as shown in the attached Appendix B.

5 Clauses 3 and 7 of the restructuring agreement are interpreted as follows: All assets of the two organized hamlets listed in the Rural Municipality of Parkdale No. 498’s tangible capital asset registry shall be vested in the Resort Village of Turtle View’s name. This includes all municipal land, land improvements, buildings, equipment, infrastructure and other small tools and equipment located within the organized hamlets.


6 The council for the new municipality of the Resort Village of Turtle View consist of a mayor and three councillors.

7 An election for mayor and councillors for the new municipality of the Resort Village of Turtle View be held on Saturday, August 3, 2019:

(a) Nomination Day for the election be Saturday, June 29, 2019, from 11:00 a.m. to 2:00 p.m. at the Fire Hall, 116 Golden Sands Drive, Indian Point – Golden Sands.

(b) the terms of office for the mayor and councillors elected on August 3, 2019, shall commence January 1, 2020, the effective date of incorporation, and expire at the time of the general election to be held on July 25, 2020.

8 Darcy Olson of Rosetown, Saskatchewan, be appointed as Returning Officer, to conduct the 2019 election in accordance with The Local Government Election Act, 2015.


9 Remuneration for the election officials be: Returning Officer – $30.00 per hour; Deputy Returning Officer – $20.27 per hour plus $44.00 for training (if required); Poll Clerk – $16.82 per hour plus $44.00 for training (if required).

10 All election expenses be shared between the two organized hamlets.

11 The first meeting of the elected council be held Saturday, January 4, 2020, at 10:00 a.m. in the resort village municipal office.

12 Darcy Olson of Rosetown, Saskatchewan, be appointed acting administrator for the first meeting of the council.


13 Sheryl Ballendine of Meota, Saskatchewan, be appointed to adjust and settle the assets and liabilities of the former organized hamlets and the Rural Municipality of Parkdale No. 498 in accordance with the restructuring agreement and this Order, including:

(a) the sale of, the disposition of and the conversion into money of sufficient assets to satisfy the liabilities of the former organized hamlets;

(b) the allocation of any grants, surplus funds and reserves, and the manner of dealing with the liabilities, pursuant to subsection 63(4) of The Municipalities Act. If there are insufficient realizable assets to satisfy the liabilities of the Rural Municipality of Parkdale No. 498 and the former organized hamlets, this appointed person may assess, levy, collect and enforce payment of any amount that may be required to satisfy the liabilities of the municipality and all associated expenses; and

(c) the authority to execute any required agreements or documents on behalf of the Resort Village of Turtle View for the period commencing on the date of this Order and until the first meeting of the elected council of the Resort Village of Turtle View. Any agreement or document signed under this authority shall not be for a term longer than 12 months.

14 Remuneration for settling the assets and liabilities be paid to Sheryl Ballendine at a rate of $50.00 per hour, 45.14 cents per travelled kilometre, and reimbursement of related miscellaneous expenses, and be paid by the Resort Village of Turtle View.

15 All bylaws and resolutions in force in the Rural Municipality of Parkdale No. 498 continue in force as the bylaws and resolutions of the Resort Village of Turtle View for one year or until they are sooner repealed or others are made in their place.

16 Notwithstanding clause 14, any bylaws in force in the Rural Municipality of Parkdale No. 498 pursuant to The Planning and Development Act, 2007, continue in force as the bylaws of the Resort Village of Turtle View until they are repealed or others are made in their place.

17 Any proceedings commenced by the Rural Municipality of Parkdale No. 498 pursuant to The Tax Enforcement Act on any real property within that portion of the rural municipality that is incorporated as the new resort village are, for all purposes, deemed to have been commenced by the resort village, and after the order is made the administrator of the resort village shall carry out all the duties imposed by The Tax Enforcement Act respecting redemption and furnishing of returns to the Registrar of Titles, and title to the real property is to be issued in the name of the resort village.

18 As soon as possible after the effective date of this Order, the administrator of the rural municipality shall provide to the administrator of the resort village a copy of the assessment and tax roll for the part of the rural municipality that now comprises the new resort village.

19 The effective date of this Order is January 1, 2020.

APPENDIX BRestructuring Agreement

Opening Statements

1. This is an agreement of the intention of the Organized Hamlet boards of Turtle Lake Lodge and Indian Point Golden Sands (RV of East Side Resort of Turtle Lake) and the Rural Municipality of Parkdale No. 498, recognizing there is no legal status of the Organized Hamlets until a Resort Village is created.

Restructuring Principles

2. All parties agree to respectfully work together to negotiate sustainable, long-range mutual benefits to their citizens now and in the future.

Disposition of Assets

3. The assets and liabilities of the two OH’s shall become the assets and liabilities of the RV.

4. Cash assets of the Organized Hamlet’s remaining at the date of incorporation will be transferred to the RV. This will include accounts for special purposes, being the IPGS Parking lot reserve fund and deduct any debts owing, being the Turtle Lake Lodge for Corrigal Crescent liability.

5. Any outstanding arrears at the time of incorporation shall be paid to the RM by the RV, and become the collectable of the RV.

6. It is recognized that the RM may incur the majority of expenses, prior to the incorporation, in the year of incorporation. Therefore all current taxes in the year of incorporation, will be paid to the RM and the RM will pay them, as collected, less any incurred expenses to the RV.

7. The RV has no claim on any capital assets of the RM.

8. The RM shall transfer to the RV the following lands:

- the 40-acre parcel on the LSD 5 22-53-18 W3M that includes the lagoon and transfer station;

- Turtle Lake Grid Road No. 697 from Turtle Lake Lodge Organized Hamlet Boundary to Twps. Road No. 524 and including Twps. Road No. 524 from Turtle Lake Grid Road west to R.R. 3190, being the west boundary of the RM of Parkdale.

9. The RV shall pay the RM 13,201.00 for the above stated transfer of property.

10. Lagoon and Transfer station accounts will not be transferred until the ownership of LSD 5 22-53-18 W3M is completed, as the RM would still be liable until the RV is the title owner.

11. The Rural Municipality of Parkdale would no longer be responsible for any costs related to the above stated property and the East Side Resort Village would not be required to pay any road costs related to the roads retained by the RM of Parkdale.

12. If the RV is established, the RM recognizes that the RV will move forward with the annexation of the following lands, subject to the processes and approvals of Community Planning;

- all property west of Grid Road No. 697 that is south of Turtle Lake Lodge and north of Twps. Road 530 from the Turtle Lake Grid Road No. 697 west to Turtle Lake (southern boundary of Sunset View Beach);

- the RM will be responsible for the maintenance of Twps. Road 530 from the Turtle Lake Grid Road No. 697 west to Turtle Lake;

- the RV will be responsible for all other roads within those boundaries except the access road to Sunset View Beach.


Boundaries

13. The boundaries of the RV will consist of:

(a) the former boundaries of the OH of Turtle Lake Lodge;

(b) The former boundaries of the OH of Indian Point Golden Sands;

(c) The roadway described as Turtle Lake Grid Road No. 697 from Twps. Road 532 north to the Turtle Lake Lodge Organized Hamlet Boundary (the pavement);

(d) The roadway described as Turtle Lake Grid Road No. 697 from Twps. Road 532 south to Twps. Road No. 524 and Twps. Road 524 from Turtle Lake Grid Road west to R.R. 3190, being the west boundary of the RM of Parkdale. (7.5 miles gravel road);

(e) LSD 5 on 22-53-18 W3M.

Service Delivery

14. RM residents will have access to the RV lagoon and transfer station on a user pay basis at the same rate as Resort Village residents.

15. The RM of Parkdale, being the first call from 911 dispatch for the area, has offered Fire Protection for a retainer fee of $15,000.00 per annum, which has not been accepted.

Amendments

16. This agreement is pending review by MLT Aikins Law Office.

Effective Date

17. This agreement will come into effect on the date of incorporation of the RV as set out in the Minister’s Order.

All material for publication in The Saskatchewan Gazette must be submitted electronically (MS Word or WordPerfect) accompanied by a signed hard copy to Publications Saskatchewan, Ministry of Justice, B19-3085 Albert St., Regina SK S4S 0B1, tel. (306)787-6948, or by E-mail: [email protected].

Each document or disk must be complete in the form required for publication and must be separate from the covering letter. Signatures on all documents must be typewritten or clearly printed immediately below the written signatures.

Prepayment is required for ALL notices placed in The Saskatchewan Gazette by non-government clients. Cheques or money orders must be made payable to the Minister of Finance. Please include the GST in addition to regular charges at the rate of 5% each for those items listed below under “GST Payable”.
