AMENDMENTS TO THE RULES OF PROCEDURE AND CONDUCT

OF BUSINESS IN THE NATIONAL ASSEMBLY, 2007

73. DR. NAFISA SHAH, MNA to seek leave under sub-rule (4) of rule 293 of the Rules of Procedure

and Conduct of Business in the National Assembly, 2007 to move the following amendments in the said Rules:-

Amendment in Rule 108 of the Rules of Procedure.- that in the Rules of Procedure and Conduct of Business

in the National Assembly, 2007, in rule 108, sub-rule (1) the following amendment may be made:-

The Speaker or Chairman of a Committee shall summon a member in custody on the charge of

bailable or non-bailable offence to attend a sitting or sittings of the Assembly or meeting of a

Committee of which he is a member.

"CHAPTER XXIII

PUBLIC PETITIONS

295. Right of petition.- (1) Any citizen of Pakistan or any natural or legal person residing or having a

registered office in the country shall have the right to address, individually or in association with other

citizens or persons, a petition to the National Assembly on a matter which affects him, her or them

directly.

(2) Petitions shall be addressed to the Speaker of the National Assembly and shall be titled as

“Public Petition to the National Assembly” and shall show the name, nationality and permanent address

of each petitioner.

(3) Where a Petition is signed by more than one Petitioner, the signatories shall designate a

representative who shall be regarded as the petitioner for the purposes of this Title.

(4) Each Petitioner may at any time withdraw support of petition in writing and on withdrawal of

support by all the petitioners the petition shall become null and void.

(5) Petitions must be preferably written in official languages, either English or Urdu and sent to the

National Assembly Secretariat. However petitions in Provincial or local languages e.g Sindhi, Punjabi,

Pashto, Balochi, Kashmiri, Shina, Hindko or Brahvi will also be considered.

(6) Petitions shall be entered in a register in the order in which they are received if they comply with

the conditions laid down in sub-rule (2); those that do not shall be filed, and the petitioner shall be

informed of the reasons for this.

(7) Petitions entered in the register shall be forwarded by the Speaker to the Public Petitions

committee responsible, which shall first establish the admissibility or otherwise of the petition in

accordance with these Rules.

(8) Petitions declared inadmissible by the Committee shall be filed; the petitioner shall be informed

of the decision and the reasons for it. Where possible, alternative means of redress may be

recommended.

(9) Petitions, once registered, shall as a general rule become public documents, and the name of the

petitioner and the contents of the petition may be published by the National Assembly for reasons of

transparency.

(10) Notwithstanding the provision of sub-rule (9), the petitioner may request that his or her name be

withheld in order to protect his or her privacy, in which case the National Assembly must comply with

the request. Where the petitioner's complaint cannot be investigated for reasons of anonymity, the

petitioner shall be consulted so as the further steps to be taken.

(11) The petitioners may request that his or her petition be treated confidentially, in which case

suitable precautions shall be taken by Parliament to ensure that the contents are not made public. The

petitioners shall be told under which precise conditions this provision is to apply.

(12) Where the Committee deems it appropriate, it may refer the matter to the Ombudsman or to the

relevant Government departments or Divisions for redressal.

296. Examination of petitions, Redressal and Report.- (1) Admissible petitions shall be considered

by the Committee where the petitioners may be invited to participate in meetings of the Committee if

their petition is to be the subject of discussion, or they may ask to be present. The right to speak shall be

granted to petitioners at the discretion of the Chair.

(2) The Committee shall submit report to the Parliament. The Committee shall, in particular, inform

Parliament of the measures taken by the Committee on petitions referred to them by the Parliament.

(3) The Committee may seek opinions from other committees that have specific responsibility for

the issue under consideration.

(4) Where the report deals with, in particular, the application or interpretation of law or proposed

changes to existing law, the Standing Committee responsible for the subject-matter shall be associated. If

the Committee responsible does not accept such suggestions, the associated committee may table them

directly in the House.

(5) When investigating petitions, establishing facts or seeking solutions the Committee may

organize fact-finding visits to the region concerned by the petition. Reports on the visit shall be drafted

by their participants.

(6) The petitioner shall be informed of the decision taken by the Committee and the reasons for the

decision. When consideration of an admissible petition has been concluded, it shall be declared closed

and the petitioner informed.”

74. DR. NAFISA SHAH to move under sub-rule (5) of rule 293 of the Rules of Procedure and Conduct of

Business in the National Assembly, 2007, that the proposed amendments be taken into consideration.

75. DR. NAFISA SHAH to move that the proposed amendments in the Rules of Procedure and Conduct of

76. MR. FAIZ ULLAH to seek leave under sub-rule (4) of rule 293 of the Rules of Procedure and

Conduct of Business in the National Assembly, 2007 to move the following amendments in the said Rules:-

Amendment in Rule 122 of the Rules of Procedure.- In the Rules of Procedure and Conduct of Business in

the National Assembly, 2007, hereinafter referred to as the said Rules, in Rule 122, for the expression “, a Bill,

other than a Finance Bill,” the words “every Bill including Finance Bill” shall be substituted.

Amendment in Rule 187 of the Rules of Procedure.- In the said Rules, in Rule 187, in the second proviso for

the word “four days” the words “ten days” shall be substituted.

Insertion of new Rule 197-A in the Rules of Procedure.- In the said Rules, after Rule 197, the following new

Rule 197-A shall be inserted, namely:

197-A. (1) The Federal Government shall present a Quarterly Report on the execution of the budget

passed by the Assembly. The report shall, when received, be laid on the table by Minister for Finance.

(2) Every quarterly report, shall stand referred to the Standing Committee on Finance Revenue

which will scrutinize the report and present its findings to the House within the number of days allocated

by the Speaker. After the Committee report is presented to the House, the Speaker shall fix a number of

days for its discussion.

(3) The Assembly may, by a resolution, express its opinion or make any observation or

recommendation on the report.

Amendment in Rule 201 of the Rules of Procedure.- In the said Rules, in Rule 201,

(i) after sub-rule (1) the following new sub-rules shall be inserted, namely:-

“(1A) A Committee shall also consider the Demands for Grants of the concerned

Ministries/Departments and make a report on the same to the Houses. The report shall

not suggest anything of the nature of cut motions.

(1B) The following procedure shall be followed by each of the Standing Committees in their

consideration of the Demands for Grants and making a report thereon to the House:-

(a) after the general discussion on the Budget in the House is over, the House shall be

adjourned for a fixed period not less than thirty days;

(b) the Committees shall consider the Demands for Grants of the concerned Ministries

during the aforesaid period;

(c) the Committees shall make their report within the period and shall not ask for more

time;

(d) the Demands for Grants shall be considered by the House in the light of the reports of

the Committees; and

(e) there shall be a separate report on the Demands for Grants of each Ministry.”

(ii) in sub-rule (6),-

(a) for the words “Public Sector Development Program (PSDP) the words “complete Demands

for Grants and Budgetary Proposals” shall be substituted;

(b) for the words “budgetary proposals relating to the Public Sector Development Programme

(PSDP)” the words “complete budgetary proposals” shall be substituted;

(iii) in sub-rule (7), for the words “PSDP” the words “budgetary proposals” shall be substituted.

77. MR. FAIZ ULLAH to move under sub-rule (5) of rule 293 of the Rules of Procedure and Conduct of

Business in the National Assembly, 2007, that the proposed amendments be taken into consideration.

78. MR. FAIZ ULLAH to move that the proposed amendments in the Rules of Procedure and Conduct of

Business in the National Assembly, 2007, be adopted.

79. MR. SHER AKBAR KHAN to seek leave under sub-rule (4) of rule 293 of the Rules of Procedure and Conduct
