Since1907,theCityofLyonhasbeentheownerofabuildingcomplexcalledthe“MaisonduChamarier”,initsprivateestate,boundedbytheRueSaint-Jean,theRueSainte-Croix,theRueMandelotandtheRuedelaBombardeintheConservationAreaofOldLyon(5tharrondissementofLyon),locatedintheheartoftheHistoricSiteofLyon,classedasaWorldHeritageSitebyUNESCOin1998.
ComingwithinthescopeofthearchitecturalprescriptionsoftheConservationandDevelopmentPlan(PSMV)oftheConservationAreaofOldLyon,thisbuildingcomplexwhichisoneoftherarecanonicalhousesstillstandingandrelativelylittlealteredovertheyears,isalsothesubjectofheritageprotectionmeasuresduetoitslistingandclassificationasaHistoricMonument.
Withaview to conservingandupgrading itsmostsignificantbuildings, in2001 in thecontextof the“HeritageConvention1998-2007”inpartnershipwiththeState,theCityofLyonembarkedonaproceduretorestorethe“MaisonduChamarier”,comprisinginparticularworkstomakegoodtheelevationsontothecourtyardandtheexternalgalleriesandaccessbalconiescompletedin2005.
However, thisbuildingcomplexover4 floors (pluscellars),currentlyunoccupiedexceptforthegroundfloorwhichhousesacommercialbaker’s/confectioner’s/ice-creammaker’sshopcalled“AlaMarquise”,still
requiresmajorrefurbishmentworkinvolvingallthebuilding trades,and including theupgradingof itsinternalspaces.
To this end, the City of Lyon wishes to place thisremarkable building complex in the hands of anoperator able to propose a scheme combining a quality upgrade and a long-term refurbishmentofthisemblematicbuildinginLyon.
ThecomplexwillbemadeavailablebytheCityofLyontoanoperatorinthecontextofaleaseconstitutingrightsinremforaminimumtermofeighteenyearsandamaximumtermofninety-nineyears,includinginreturntheobligationontheoperatortocarryoutthenecessaryworksfortherestorationandupgradingofthebuilding.
Attheendofthelease,thebuildingworkcarriedoutwillautomaticallybecomethepropertyoftheCityofLyonwithoutpayment,althoughtheLocalAuthoritywillhavetheoptionofallowinganewlease.
TheCityofLyonisorganisingaconsultation in two rounds,attheendofwhichthetenantwillbeselected.
Accordingtotheforecastcalendaroftheconsultationplans,thewinningtenderwillbeselectedinthe2nd quarter of 2016.

Thebuildingcomplexcomprisestwoadjacentbuildings(withnointernalaccesstoeachother)withacommoninternalcourtyard:
•The“MaisonduChamarier”at37rueSaint-Jean,datingfromtheRenaissance(16thcentury),isclassedasaHistoricMonumentwiththenameHôteld’Estaingunderthetermsofaministerialorderdated15September1943.
•ThisbuildingarrangedinaU-shapeisboundedbytheRueSaint-Jeantothewest,theRuedelaBombardetothenorthandtheRueMandelottotheeast,thebuildingbeingboundedtothesouthbyawallontotheRueSainte-Croix,therebyforminganapprox.90m2internalcourtyardfortheentiretenement.
•Theinteriorcourtyardformedthesubjectofarestorationin2005inordertorestoreittoitsinitialstatewiththerestorationofthefloorinparticular.
•Themainelevationofthebuilding,locatedontheRueSaint-Jean,comprises4levels,andincludescellars/basements.

TheCityofLyonistheownerofthe“MaisonduChamarier”andtheadjoiningbuildingat2rueMandelot,followingalegacyofwhichitwastheuniversallegateeandwhichincludesaclauseofinalienabilitypreventingitfromsellingthem,acceptedbydeliberationoftheMunicipalCouncilon25March1907.

“TheoldestremainsinthiscanonicalhousewhichwastobecometheresidenceoftheChamarier–ahighdignitaryofthechapterresponsibleforthekeysandpolicingofthecloister-datebacktothe13thcentury;atthattime,itseemstohavealreadycomprisedatleasttwoperpendiculardwellings:oneontotheRueSaint-Jean,inthesouthwestcorneroftheblock,andtheotherontothecourtyardinthenortheastcorner.Inthecourseofthe14thand15thcenturies,thisstructurewassubjecttoanumberofmodifications,ofwhichlittleremainsotherthantheworktothecourtyardaccessfromRueSaint-Jean.Theremainsofthetransformationscarriedoutduringthistimeareveryfragmentedastheywerelargelyobliteratedbythemajorrestructuringworkeffectedintheperiodwhichfollowed.Inthe16thcentury,majorworkswerecarriedoutbytheChamarierFrançoisd’Estaing(bishopofRodezin1529)andthenbyhisnephewCharles.Withintheframeworkinplacesincethe13thcentury,theyreorganisedthespaceandtransformedapiecemealdwellingintooneenormousresidentialbuildingwhichadoptstheclassicpatternoftheurbanhouseintheRenaissance:severaldwellingsconnectedbyaspiralstaircaseandexteriorgalleries.Thisnewarchitecturewassupplementedbyadecorativeprogrammeofpaintedrender,numerousfragmentsofwhicharevisible;themostremarkabledecorationisprobablythepaintedfrescointheItalianatehumanistofficeinthewestgallery.Awellandawashingfountain,attributedtothearchitectPhilibertdel’Orme,decoratethecourtyardofthistownwhichbecameoneofthemostbeautifulhomesinthedistrict.Itwasthesedecorativeitemswhichweretobemodifiedoverthesubsequentcenturies.Inthisway,onecantrackthesequenceofthevariouschamariersinthe17thcenturyviathesuccessionofpainteddecorationsandblazons”.

The“MaisonduChamarier”underwentarestorationschemewhichwascompletedin2005,jointlyfundedbytheCityandtheState,inthecontextofthe“HeritageAgreement1998-2007”.
Therestorationworkscarriedoutrelatedmainlytotheexternalstructureofthe“MaisonduChamarier”andtheinternalcourtyard,comprising:
•there-openingofthegalleries;•theremovalofonegallerytore-establishtheinitialpositionoftheroofing;•therestorationofsomeofthepainteddecoration;•therepairoftheelevationsoverlookingthecourtyardwiththere-openingorreinstatementoftheoriginalmullionedwindows;•therestorationorreinstatementofwoodjoineryworkandwindowpanes;•therestorationandreinstatementofthecourtyardflooring;•therefurbishmentoftheroofingoverlookingthecourtyard;•there-openingofthepassagetotheRueSaint-Jean.
However,whiletheworksallowedtheconservationofthepartsconcerned,inparticularthestructuralframeofthebuilding,the“MaisonduChamarier”todaysuffersfromanumberofpathologiesandstructuralproblemsaffectingitsinternalspaces.
TheheritagestudyconductedbytheSeniorArchitectforHistoricMonuments,DidierREPELLIN,inJuly2014,reportedonthesequenceofdeteriorationinthebuilding,roombyroom.

Itisstatedthatthepropertyisletinitscurrentstateandcondition,withoutredressorclaimagainstthelandlordforanyreasonwhatsoeverandwithouttherighttoclaimanyindemnityduetothepoorstateoftheproperty,thebasement,theground,visibleorhiddenstructuraldefects,lackofsolidityofthestructureoftheedificeoranyotherreason.
Asetoftechnicaldiagnosesforthebuildingcomplexhasbeenproducedwithregardtothefollowingaspects:
• Mission report for identifying materials and substances containing asbestos(havingconcludedthelow-levelpresenceofmaterialsandsubstancescontainingasbestosinthebuildingsfromavisualnon-destructiveinspection);
• lead diagnosis before works or demolition;
• structural diagnosis;
• diagnoses with regard to parasitic activity(expertreportonbiologicalpathologiesinthetimber).
Theycanbeprovidedbye-mailifrequested.
10-indicativesumofworks
Thesumoftheworksfortherestorationandrehabilitationofthestructurehasbeenestimatedbythemunicipaldepartmentstobeat least 7 million euro excl. vat (excludingprojectmanagementfees,archaeologicalexcavations,contingenciesetc.).
Thissum,whichispurelyforinformationonlyasitmayneedtochangedependingonthepossiblefutureuseoftheproject,issimplyanevaluationofthelevelofinvestmenttobeplannedforthisscheme.

TheextremelyricharchitecturalheritageofOldLyonwasthejustificationfortheneedtopreserveandshowcasethisancient25-hectaredistrictbythecreationofaConservationAreabytheinter-ministerialorderof12May1964ontheterritoryofSaint-Jeaninteralia.ItwasthefirstconservationareainFrance,inapplicationofthe“Malraux”actof4August1962,andoneofthelargestRenaissancedistrictsinEurope.
InthisConservationArea,particularplanningrulesapply,beingbroughttogetherintheConservationandDevelopmentPlan(PSMV)forOldLyon,towhichthelegislativeprovisionsdefinedbyarticlesL313-1toL313-3oftheUrbanDevelopmentCodeapply.ThePSMV,intheConservationAreaofOldLyon,hasthevalueofanurbanplanningdocumentandthusreplacestheLocalUrbanDevelopmentPlan.

The“MaisonduChamarier”andtheadjoiningbuildingat2rueMandelotarelocatedinthegreenzoneofthenaturalriskpreventionplanforthefloodingoftheRhôneandtheSaôneintheterritoryofGreaterLyon.
Accordingtoitsregulations, “the green zone covers the areas with a risk of flooding due either to a rise in the piezometric level of the groundwater, or to the overflowing of a drainage system due to its saturation.In order to take into account the problem of basement flooding, a recurrent event in the territory of Greater Lyon in particular close to the Saône and the Rhône, the risk indicated for the green zone includes the zones where the first underground level is potentially at risk.

Moreover,thearchitectmustprovidehigh-levelreferenceswithregardtotheplannedschemeandaten-yearexperienceinthefieldoftherestorationofancientstructures.Thearchitectmustprovideinhisapplicationfile,referencesdemonstratinghisprofessionalabilitytodealwiththecharacteristicsandthecomplexityoftheplannedrestorationproject.Tothisend,thereferencefileshallincludealistoftherestorationprojectshehasmanagedandcompriseatleastonerestorationprojectinrelationtotheplannedscheme.Heshallhavebeenresponsibleforthedesignandtheimplementation.Ifapplicable,thefilemayreportonagroupformedwithrelevantspecialiststorespondtotheobjectivesdefinedintheconsultationrules.ThecheckontheequivalenceofEuropeandegreesanddiplomaswillbecarriedoutbytheGeneralHeritageDirectorate–departmentforhistoricmonumentsandprotectedspaces.

ThespecificationsofheritageconstraintsincludedinthestudyoftheSeniorArchitectofHistoricMonuments,DidierREPELLIN,ofJuly2014,appendedtothepresentspecifications,mustbetakenintoaccountwhenproducingtherestorationandrefurbishmentprogrammeforthepremises.
Itpresents,roombyroom,ahierarchyofarchitecturalelements(painteddecoration,trimsetc.)whichneedtoberestoredorpreservedasevidence,inorderofimportance.
Itidentifiesinparticularthespiralstaircaseasoneofthemostremarkableheritageelementstobepreserved.
However,itisstatedthatithasnotbeenpossibletorevealagreatdealofpainteddecoration,despiteithavingbeenlocatedbysurveys.thus, the knowledge of the building is incomplete.Additionalinvestigationswillneedtobeprovidedbythetenant,inparticularonthenorthwallofthe“MaisonduChamarier»(formercanonicalenclosure).
Thespecificationoftheheritageconstraintswasthusproducedwiththedataknowntodate,and is subject to subsequent additions of all kinds from archaeological surveys.

ThetenantshalltakecognizanceoftheprovisionsofsectionIIofbookVoftheHeritageCode.
Heshallalsotakeintoconsiderationthepreliminarystudytotheworksonthe“MaisonduChamarier”carriedoutbytheArchaeologyDepartmentoftheCityofLyon(SAVL)inOctober2014,andappendedtothepresentspecification.
Dependingonthenatureoftheplanneddevelopment,theRegionalDirectorateforCulturalAffairs/RegionalArchaeologyDepartmentmaybecalledupontoprescribeanarchaeologicaldiagnosiswhichmaybefollowedbyexcavations.Theseinterventionsmayrelatetothesoilandthestructureinelevation.Conservationmeasuresforremainsmaybeplannedinconsultationwiththedeveloper.Thecostofthearchaeologicalexcavationwillbebornebythedeveloper.

•toregeneratethepremisesaccordingtotheuseplannedbythetenant,whilerespectingtheirhistoric,architecturalandheritagequalities.

Expectedofthecandidatesallowedtopresentatenderisaschemereconcilingtherequirementsofaresto-rationsensitivetothehigharchitecturalandhistoricqualityofthisheritage,incompliancewiththeap-plicableregulationsandwithregardtoitsstatusasalistedbuilding,andarefurbishmentguaranteeinglong-termusecompatible with the opening of the internal courtyard to the public.
Assuch,theCityofLyondoesnotimposeanyspecificconstraintwithregardtothefutureuseofthe“MaisonduChamarier”,asthisisnotstrictlyimposedbytheregulatoryprovisionsoftheConservationandDeve-lopmentPlan(PSMV)forOldLyon.

•accessibilityofthepublictotheinternalcourtyard.
