THIS SOLICITATION AMENDMENT NO. 008 IS RAISED TO:
A. Provide notification to suppliers; B. Respond to questions received from suppliers; and C. Amend the RFP.
A. NOTE TO THE BIDDERS
As per section 7.2.1, General Conditions of the RFP, it states that “2035 (2020-05-28), General Conditions -Higher Complexity – Services (“General Conditions”), apply to and form part of the Contract.” Please be informed that PSPC has updated the Code of Conduct for Procurement to create new expectations for vendors, and their sub-contractors, on human and labour rights. The revised Code is effective immediately and applies to the resulting contract for the Inbound Warehousing & Distribution Solution (IWDS) (5A090-213240/A) of Indigenous Services Canada. Although this RFP states that "this is an open tender. However, it will be conditionally set-aside under the Government of Canada's procurement Strategy for Aboriginal Business (PSAB)", the mandatory requirements outline is, in our opinion, excessive in nature and favor only the top, largest, elite corporations in the industry.

a) For example, the points awarded in the RFP to bidders with software in the "magic Gartner quadrant" is excessive considering the work outlined does not require such an exclusive software investment. The requirements in the contract can be easily fulfilled by many different, well-known and recognized software programs. This requirement favours large corporations that have the funds to invest in very expensive software options (that are not required for the requirements outlined). b) Another example would be the requirement to hold such a large area of excess space -"the warehousing must be scalable to 1.5X should the quantity of inventory and shipments increase". This requirement to hold that much empty space again favors only a few of the largest corporations in the industry. We feel that with reasonably short notice there are many other options available to free up/acquire additional space.

a) Please see Revision #003 in Amendment 008 on changes to Attachment 4.1 - Technical Evaluation Criteria. Canada removed this particular point rated criterion in Table 3. Point Rated Criteria - System Capabilities and adjusted the technical evaluation criteria accordingly.
b) Given the uncertainty of communicable disease emergencies such as the current pandemic, the scalability requirement is critical as part of the resulting Contract to ensure that the Contractor is equipped to handle and manage scaled-up operations for future needs of ISC to respond to communicable disease emergencies.
As per section 3.2 of the SOW, it states that:
3.2.1 The Contractor must take into account the possible growth or reduction in space over the term of the Contract: a. The warehousing must be scalable to 1.5X should the quantity of inventory and shipments increase; and b. Reduction in space over the term of the Contract once the COVID-19 pandemic is contained.
3.2.2 Within four weeks upon request by the Project Authority, the Contractor must scale up to satisfy 1.5x storage and shipments requirements outlined at sub-article 3.1.2 for peak monthly inventory, for all prescribed activities in this Annex A - Statement of Work (Canada Centre Province) (“SOW”), and the inclusion of additional product lines, as required.
Therefore, the additional space with respect to scalability requirement is not required upon contract award and will only be required at the time when requested by the Project Authority during the Contract period.

No mention or consideration for the importance, or the understanding, of Indigenous communities and their abilities/resources (human and mechanical) to efficiently receive, store and process the orders contemplated by this RFP. No recognition or points allotted to that societal knowledge and technical experience.

ISC liaises with the specified destinations to support the Indigenous communities in efficiently receiving, storing, and completing the order processing of PPE.
As per mandatory criteria M6 and M7, bidders must describe their ability, processes, and capacity to ensure the timely and safe delivery of shipments to the final destinations (the final leg of distribution), including remote, isolated, and semi-isolated First Nations communities.
The Contractor and its subcontractors are also required to comply with section 3.13 Conduct of Business of the SOW: “The Contractor must conduct business in a manner that is sensitive to the unique values, socio-cultural traditions, history and needs of Indigenous peoples to facilitate Canada’s commitment to advance reconciliation.”
Therefore, there is no need to allot additional points since it is already part of the terms and conditions of the contract.

It appears that this RFP contemplates large offshore sourcing of product and storage with no consideration to local just-in-time sourcing of inventory where inventory supply and management could be provided in one solution. Please see below an example of an option for your review. A certain Canadian decentralized manufacturing vendor, has capacity to make 1000 Metric Tonnes/ Month of Meltblown/ SMS/ Spunbond materials, which equate 1 billion facemasks. In collaboration with this company and (Canadian Association of PPE Manufacturer), there is capacity to build all the Canadian needs within weeks' notice.

A Certain Canadian Company has developed complete Compostable PPE textiles, materials, and masks. These products come with Carbon Offsets and are completely sustainable here in Canada. Please consider the approach to go for environmentally safe products for this Pandemic and future needs, which will be used in our Treaty territories.

DELETE: Section 4.1 Evaluation Procedures, in its entirety and REPLACE with the following: 4.1 Evaluation Procedures (a) Bids will be assessed in accordance with the entire requirement of the bid solicitation including the
technical and financial evaluation criteria.
(b) An evaluation team composed of representatives of Canada will evaluate the bids. (c) The evaluation team will determine first if there are two or more bids with a valid PSAB certification. In
that event, the evaluation process will be limited to the bids with the certification; otherwise, all bids will be evaluated. If some of the bids with a valid certification are declared non-responsive, or are withdrawn, and less than two responsive bids with a valid certification remain, then all bids received will be evaluated.
(d) Canada will use the Phased Bid Compliance Process (PBCP) described below. (e) With respect to PSAB and PBCP, the following steps will be followed:
1. Bids are received and all are assessed pursuant to the PBCP for compliance against the Mandatory Criteria. This is not considered evaluation of the bids.
2. The PSAB is then applied to determine the number of compliant bids from Indigenous firms. 3. If two or more bids from Indigenous firms are found to be compliant only those are further considered
and subject to evaluation as described in the RFP. 4. If less than two bids from Indigenous firms are found to be compliant then all compliant bids are
subject to evaluation as described in the RFP.
