PROCEDURE OF

The challeng~ of the contested Congre~~me~ were filed on Dec. 5, 1964, in accor­dance ··with· Tft e 2 of the United States Code, Sec. 201, which outl i nes the exact steps ·to be fo lowed whenever the right to hold a seat in the Rouse of Representa­tives is ·bein5 ·ehallenged ..

The f()rmaL Not ·-ce of Challenge was delivered, personally and by mail, to the challeng·,= ~ · C ngressmen-elect and to the Clerk of the Hovse on December 5, 1964, pu~~tiant to Fe eral law.

The challenged persons then have 30 days to file their answers to the charges. The . contestant have 40 days, . beginning on the day answers are serve·d, to ' use federal subpoe a power to take testimony throughout the State of lhssissippi to support the ch rges of the challenges. This testimony will be taken at open, public liearingi • The subpoenas must be obeyed under penalty of contempt of court, and if : ocal federal judges refuse to issue subpoenas, immediate emer-gency appeals <an be taken to the hicher federal courts •
