Arles is listed as a UNESCO world heritage of humanity site for three reasons :

• its historic old city center and its Roman and Romanesque monuments,

• the pilgrimage route to Santiago de Compostela,

• a natural space of worldwide interest: the Camargue is listed as part of the world network of biosphere reserves

Arles, an inspiring city which has revealed many artists :• The dutch painter Vincent van Gogh, who lived in Arles for fifteen months. His stay in Arles corresponds to his most creative period. Many places that he painted during his stay are still visible today.

• Pablo Picasso who, in 1971, two years before his death, decided to offer fifty-seven drawings to the city. This exceptional donation is proof of his special attachment to Arles, based on his Andalusian passion for bullfighting and especially on the irresistible attraction of the “ghost” of Van Gogh.

• Christian Lacroix, famous couturier, an Arles native, who spent his childhood in the corridors of the Réattu Museum, where he discovered the “Couturière’s Workshop” by Antoine Raspal.

• The Gypsy Kings, internationally famous for their gypsy music, founded by Chico.

• The Lee Ufan Foundation, named for a world-renowned Korean artist, will be established in Arles in 2019.

• The Luma Foundation is equipping the city with a cultural center worthy of that of the largest world metropolises thanks to the work of famous architects such as Frank Gehry, Annabelle Selldorf and Bas Smets.

ARLES, THE ROMAN CITYIn 46 BC, after his victory over Marseilles, Julius Caesar thanked the Arlesians

for their help by founding here a colony ruled by Roman law, and covering an immense territory. The city rapidly became rich and superb monuments were built: forum, temples, theater, amphitheater, circus, baths… Go back in time for a visit 100% Roman !

creativity was at its utmost during his stay in Arles between 1888 and 1889.

He painted here about 200 paintings, including some of his most famous: the night café, the Langlois bridge, starry night over the Rhone… This tour will take you in the artist’s footsteps to the places he loved, such as the Summer Garden on the Boulevard des Lices, the Place du Forum, the amphitheater, the Trinquetaille bridge… where his immortal and tormented presence can still be felt.

According to tradition, the meal must be lean. The food is made up of vegetables, followed by an assortment of thirteen desserts. General sales information*Article 1 - Dispositions générales

1-1 Conformément à la loi du 22 juillet 2009, les organismes locaux de tourisme bénéficiant du soutien de l'Etat, des collectivités territoriales ou de leurs groupements peuvent se livrer ou apporter leur concours, dans l'intérêt général, à l'organisation ou la vente de voyages ou de séjours individuels ou collectifs, de services pouvant être fournis à l'occasion de voyages ou de séjours, notam-ment la délivrance de titres de transport, la réservation de chambres dans des établissements hôteliers ou dans des locaux d'hébergement touristique et la délivrance de bons d'hébergement ou de restauration, de services liés à l'accueil touristique, notamment l'organisation de visites de musées ou de monuments historiques, de forfaits touristiques, ainsi qu'a l'organisation et à l'accueil de foires, salons et congrès ou de manifestations apparentées dès lors que ces opérations incluent tout ou partie des prestations citées, dès lors que celles-ci permettent de faciliter l'accueil ou d'améliorer les conditions de séjour des touristes dans leur zone géographique d'intervention.Les Offices de Tourisme sont des organismes locaux de tourisme, mis à la disposition des prestataires et qui ont passé, avec eux, une convention de mandat.

1-2 Les présentes conditions générales de vente sont valables à compter du 1er mars 2010 et sont applicables sauf convention particulière.

1-3 Le fait que l’Office de Tourisme d'Arles ne se prévale pas, à un moment donné, d'une des dispositions des Conditions Générales ne pourra être interprété comme valant renonciation par elle-même à se prévaloir ultérieurement de l'une de ces dispositions.

1-4 Dans le cas où l'une des dispositions des Conditions générales de vente serait déclarée nulle ou sans effet, cette disposition serait réputée non écrite, sans que cela n'affecte la Dates of validity des autres dispositions, sauf si la disposition déclarée nulle ou sans effet était essentielle et déterminante.

1-5 Sont également applicables à l’offre et à la fourniture des prestations, selon des modalités identiques aux présentes Conditions Générales, les conditions spécifiques des Partenaires indiquées sur le descriptif de la prestation et sur la confirmation de réservation. L’acte d’achat et/ou de réservation signifie l’acceptation des conditions spécifiques des partenaires.

1-6 Dispositions générales relatives à la vente de prestations via le Site internet L’Office de Tourisme vend par le biais de son Site internet diverses prestations réservées aux particuliers, à titre individuel, lesquelles seront régies par les présentes conditions générales de vente. La commande de Prestations est réservée aux seuls clients ayant préalablement pris connaissance des Conditions Générales dans leur intégralité et les ayant acceptées en cochant la case ou en cliquant sur le lien hypertexte prévus à cet effet sur le Site internet. Sans cette acceptation, la poursuite du processus de commande est techniquement impossible. Le client doit être âgé d’au moins 18 ans, être capable juridiquement de contracter et utiliser ce Site conformément aux Conditions Générales.Sauf cas de fraude dont il lui appartient de rapporter la preuve, le client est responsable financièrement de ses démarches sur le Site internet, notamment de l’utilisation qui sera faite de son nom d’Utilisateur et de son mot de passe. Il garantit également la véracité et l’exactitude des informations le concernant fournies sur le Site internet. Toute utilisation du Site internet qui serait frauduleuse ou qui serait jugée frauduleuse, qui contreviendrait aux présentes Conditions Générales, justifiera que soit refusé à l’Utilisateur, à tout moment, l’accès aux Prestations proposées par les Partenaires ou autres fonctionnalités du Site internet.

Article 2 - Formation du contrat

2-1 Il est rappelé que toute commande de l’une ou plusieurs des prestations offertes par l’Office de Tourisme suppose l'adhésion sans restriction ni réserve du client aux présentes conditions générales de vente, lesquelles sont visibles et consultables soit au comptoir de l’Office de Tourisme, soit sur les pages des sites Internet www.arlestourisme.com de l'Office de Tourisme.

2-2 Réservation Toute réservation est ferme et définitive sauf exercice du droit de rétractation prévu à l’article 2-4, ou annulation dans les conditions prévues à l’article 8 des présentes Conditions générales de vente.

2-2-1 Modalités de la réservation La réservation des prestations offertes par l’Office de Tourisme peut être effectuée soit au comptoir de l’Office de Tourisme, soit via le site Internet www.arlestourisme.com

2-2-2 Dispositions particulières à la Réservation en ligne

2-2-2-1 Les descriptions et photographies des prestations référencées par l’Office du Tourisme, figurant sur le site, ont un objet purement informatif, dont le contenu peut varier en fonction du prestataire. Par conséquent, il est conseillé de se rapprocher du prestataire directement afin de recueillir des informations actualisées. Si le client ne s’estime pas suffisamment informé sur les caractéristiques des prestations qu’il souhaite commander, il peut préalablement à toute passation de commande, solliciter des informations complémentaires sur ces prestations auprès de l’Office de Tourisme. En passant commande, le client reconnaît explicitement avoir obtenu toutes les informations souhaitées sur la nature et les caractéristiques des prestations commandées.

2-2-2-2 Le contrat de prestations devient ferme et définitif lorsque le client a validé la page de sa réservation sur le Site internet sur laquelle figure le récapitulatif des prestations commandées et a procédé au paiement de l’intégralité du prix des prestations commandées. Tant que ces conditions ne sont pas remplies, le contrat de prestations ne sera pas considéré comme formé et l’Office de Tourisme ne sera nullement tenu de réaliser les prestations commandées. Dès lors que le contrat de prestations est valablement formé, celui-ci ne pourra plus faire l’objet d’aucune modification ou annulation par le client, sous réserve de la mise en œuvre de son droit de rétractation dans les conditions définies ci-après à l’article 2-4 ou accord des parties et sous réserve des dispositions des articles 8,9 et 11.

2-3 Confirmation écrite L’Office de Tourisme d'Arles s’engage à confirmer au client, par écrit électronique ou à défaut par écrit papier, au plus tard avant le début des prestations commandées, la teneur des prestations commandées ainsi que les conditions générales de vente et les modalités d’exercice du droit de rétractation dont il bénéficie, l’adresse à laquelle il peut présenter ses réclamations et les conditions relatives aux garanties commerciales dont il bénéficie.

2-4 Faculté de rétractation en fonction de la nature de la prestation En fonction du type de prestation commandée, le client bénéficie ou non d’une faculté de rétractation : Conformément aux dispositions de l’article L.121-20 du Code de la consommation, le client dispose d’un délai de 7 jours francs à compter de la date à laquelle le contrat sera ferme et définitif, dans les conditions fixées à l’article 2-2-2-2, afin d’exercer son droit de rétractation, par fax, courrier ou e-mail adressé à l’Office de Tourisme :Office de Tourisme d'Arles 43 Bd de Craponne 13200 Arles France Fax : 33 (0) 4 90 18 32 68E-mail : [email protected] En exécution de ce droit de rétractation, le client pourra annuler les prestations commandées sans aucune pénalité. En cas d’exercice du droit de rétractation, l’Office de Tourisme s’engage à rembourser le client dans les meilleurs délais et au plus tard dans les 30 jours suivant la date à laquelle il aura exercé son droit de rétractation, ledit délai courant à compter de la date de réception du fax, courrier ou e-mail de rétractation. Attention, il n’y a pas de droit de rétractation pour le client qui commande une prestation d’hébergement, de transport, de restauration, par application combinée des articles L121-20-4 al.2 et L121-18 du Code de la consommation.

Article 3 - Prix

3-1 Sauf mention contraire figurant sur le Site internet, les prix figurant sur le Site de l’Office de Tourisme d'Arles sont affichés en Euros, TVA comprise. Des taxes locales additionnelles payables sur place peuvent être imposées par les autorités locales (taxe touristique, taxe de séjour,…) et sont à la charge du client. L’Office de Tourisme d'Arles se réserve le droit de modifier à tout moment le prix de ses prestations et en accord avec le prestataire.

3-2 RèglementPour les réservations d’hébergement sec, de produits, services touristiques et packages, 25 % de la somme totale des prestations sélectionnées seront payables à la réservation et le solde 30 jours avant le début des dites prestations.Le paiement s'effectue par prélèvement bancaire, hors taxe de séjour à régler directement au prestataire à l’arrivée ou au départ, selon les conditions propres à l’établissement.

Article 4 - Conditions de réalisation des prestations

4-1 La Length de chaque prestation est celle stipulée au comptoir de l’Office de Tourisme ou sur le Site internet. Le client ne pourra, en aucune circonstance, se prévaloir d’un quelconque droit au maintien dans les lieux à l’issue de la prestation. Pour la bonne réalisation de certaines prestations, le client doit se présenter le jour précisé aux heures mentionnées ou contacter directement le prestataire.

4-2 Dispositions particulières selon les prestations commandées

4-2-1 Hébergement :

4-2-1-1 Dans le cas d’une réservation d’un hébergement, il est vivement conseillé au client de prévenir directement le prestataire de son heure d'arrivée. Le client doit se référer aux heures d’ouverture de l’établissement réservé. Le client devra libérer les chambres au plus tard à 12.00 le jour prévu pour son départ. RAPPEL : certains établissements ne disposent pas d'accueil de nuit, merci de prendre vos précautions auprès du prestataire.

4-2-1-2 Si exceptionnellement (erreur de réservation ou accident imprévu dans la chambre), la ou les chambres retenues n'étaient plus disponibles au moment de l’arrivée du client, le prestataire doit, sans aucun frais supplémentaire pour ledit client : 1. lui procurer une ou plusieurs chambres en nombre équivalent à la réservation, dans un autre établissement de classe égale ou supérieure, à un prix égal ou inférieur au prix de la ou des chambres réservées, RAPPEL : Le classement des établissements est déterminé d'après le confort et les prestations offertes. Les normes de classement sont élaborées par ATOUT France et examinées par la Préfecture. Les photos présentées ne sont aucunement contractuelles. 2. lui proposer une solution de transport jusqu'à cet établissement, 3. lui rembourser, s'il le souhaite, le prix d'une communication téléphonique entre cet établissement et sa famille ou son bureau.

4-2-2 Produits touristiques et Package / Forfaits touristiques : Les horaires indiqués sont à respecter afin de garantir le bon déroulement de la prestation. En cas de retard et sans manifestation de la part du client au sujet de son heure d’arrivée, la réservation est garantie selon le bon vouloir du prestataire. En cas d’obligation par le prestataire de ne pas attendre les clients retardataires, un report d’activité sera proposé au client. Si aucune date de substitution ne peut être trouvée, seul le client est responsable de son retard et une pénalité de 100% du montant de la prestation sera facturée. Il peut advenir que certaines activités proposées par les Prestataires et indiquées dans le descriptif figurant sur le Site, soient supprimées notamment pour des raisons climatiques, en cas de force majeure, de séjour hors saison touristique, ou lorsque le nombre de participants requis pour la réalisation de l’activité n’est pas atteint. L'annulation d'une quelconque activité pour un cas de force majeure ou en raison du comportement d'un tiers au contrat ne saurait en tout état de cause entraîner un quelconque dédommagement au profit du client par l’Office de Tourisme d’Arles Article 5 - Suppléments et modifications par le client

Toute prestation non prévue dans le forfait doit être réglée sur place. Le client ne peut, sauf accord préalable de l’Office de Tourisme, modifier le déroulement de son séjour. Les frais de modifications non acceptées restent entièrement à la charge du client. En cas de non-utilisation, les bons d’échanges ne seront pas remboursés.

Article 6 - Cession du contrat par le client

Le client peut céder son contrat à un cessionnaire qui remplit les mêmes conditions que lui pour effectuer la prestation. Dans ce cas le client est tenu d’informer l’Office de Tourisme d’Arles de sa décision par lettre recommandée avec accusé de réception, au plus tard 7 jours avant le début de la prestation. La cession du contrat doit s’effectuer à prix coûtant. Le cédant et le cessionnaire sont responsables solidairement vis-à-vis du vendeur, du paiement du solde du prix ainsi que des frais supplémentaires éventuels occasionnés par cette cession.

Article 7 - Modification par l’Office de Tourisme d’un élément substantiel du contrat

Lorsqu’avant la date prévue du début de la prestation, l’Office de Tourisme se trouve contraint d’apporter une modification à l’un des éléments essentiels du contrat, le client peut, sans préjuger des recours en réparation pour dommages éventuellement subis, et après en avoir été informé par l’Office de Tourisme par tous moyens :-soit résilier son contrat et obtenir, sans pénalités, le remboursement immédiat des sommes versées. Il recevra en outre une indemnité au moins égale à la pénalité qu’il aurait supportée si l’annulation était intervenue de son fait à cette date telles que définie à l’article 8 des présentes Conditions générales de vente. -soit accepter la modification ou la substitution de prestations proposée par l’Office de Tourisme, un avenant au contrat précisant les modifications apportées étant alors signé par les parties. Si la prestation de substitution est moins chère que la prestation commandée, le trop-perçu sera restitué au client avant le début de la prestation.

Article 8 - Annulation du fait du client

Toute annulation totale ou partielle doit être notifiée :- via le Site internet [email protected] en indiquant le numéro de réservation, - ou en contactant directement le service par téléphone au +33 4 90 18 41 26 ou +334 90 18 41 22, du lundi au vendredi hors jours fériés.

Si le client a contracté une assurance-annulation : il convient de se reporter aux conditions de remboursement prévues dans le contrat d’assurance.Si le client n’a pas contracté d’assurance-annulation, en cas d’annulation totale ou partielle par le client, l’Office de Tourisme appliquera de plein droit au client des pénalités, dans les conditions ci-après fixées :

8-4 - Produits touristiques et Packages / Forfaits touristiques - En cas de résiliation plus de 30 jours avant le début du séjour, une somme égale à 25 % du prix du séjour restera acquise à l’Office de Tourisme d’Arles.- En cas de résiliation moins de 30 jours avant le début du séjour, la totalité du prix du séjour restera acquise à l’Office de Tourisme d’Arles.- Un départ anticipé ou une arrivée retardée ne donnera lieu à aucun remboursement.Il est entendu que les pénalités ainsi retenues seront reversées aux prestataires respectifs.Dans tous les cas, l’Office de Tourisme d’Arles conservera les frais de dossier ainsi que sa rémunération.Les activités liées à l’organisation et à la vente de voyages ou de séjours à une date déterminée ou à une période spécifiée ne sont pas soumises au délai de rétractation de 7 jours applicable à la vente à distance.

Article 9 – Annulation du fait de l’Office de Tourisme du d’Arles

Lorsqu’avant le début de la prestation, l’Office du Tourisme d’Arles annule la prestation, il doit en informer le client par lettre recommandée avec accusé de réception.Le client, sans préjuger des recours en réparation des dommages éventuellement subis, sera remboursé immédiatement et sans pénalité des sommes versées, il recevra en outre une indemnité égale à la pénalité qu’il aurait supportée si l’annulation était intervenue de son fait à cette date telle que définie à l’article 8 des présentes Conditions Générales de vente. Ces dispositions ne s’appliquent pas lorsqu’est conclu un accord amiable ayant pour objet l’acceptation par le client d’une prestation de substitution proposée par l’Office du Tourisme.

9-1 Dispositions particulières concernant certains types de prestations qui requièrent un nombre minimum de participants L’insuffisance du nombre de participants peut être un motif valable d’annulation pour certains types de prestations. Dans ce cas, l’Office du Tourisme d’Arles restitue la totalité des sommes versées correspondantes. Cette éventualité ne saurait intervenir moins de 24 heures avant le début de la prestation.

Article 10 - Responsabilité

10-1 L’Office de Tourisme qui offre à un client des prestations est l’unique interlocuteur de ce client et répond devant lui de l’exécution des prestations commandées et des obligations découlant des présentes conditions de vente.

10-2 Les programmes de l’Office de Tourisme d’Arles dépendent des jours et heures d’ouverture des différents monuments, musées et établissements. En cas de fermeture imprévue, l’Office du Tourisme ne pourra, en aucun cas, être tenu pour responsable pour la non-réalisation d’un programme qui n’est pas dû à son propre fait.

10-3 L’Office de Tourisme ne peut être tenu pour responsable de l’inexécution totale ou partielle des prestations commandées ou du non-respect total ou partiel des obligations stipulées dans les présentes conditions générales de vente, en présence de cas fortuits, de cas de force majeure, de mauvaise exécution ou de fautes commises par le client, ou de faits imprévisibles et insurmontables d’un tiers étranger à la fourniture des prestations.

10-4 En aucun cas, l’Office de Tourisme d’Arles ne saurait voir sa responsabilité engagée en cas d’utilisation de ces contrats par des tiers ou à des fins autres que touristiques.

Article 11 - Force majeure

11-1 On entend par force majeure tout événement extérieur aux parties présentant un caractère à la fois imprévisible et insurmontable qui empêche soit le client, soit les voyageurs, soit l'agence ou les prestataires de services impliqués dans la réalisation du voyage, de l’exécution d’une ou de prestation(s), d'exécuter tout ou partie des obligations prévues par le contrat. Il en sera notamment ainsi en matière de grève des moyens de transport, de manifestations, du personnel, de conditions climatiques (intempéries, tempêtes...), des conditions hydrologiques (crues, inondations...), fermeture d’établissements, et géographiques.

11-2 La survenance d’un cas de force majeure suspend les obligations des présentes affectées par ce dernier et exonère de toute responsabilité la partie qui aurait dû exécuter l'obligation ainsi affectée. Le prestataire se réserve le droit d’annuler toute réservation en cas de force majeure et d’en modifier la date. Si le prestataire se trouve dans l’obligation d’annuler la prestation avant que le client ait pu commencer l’activité, un report de l’activité lui sera proposé.

Article 12 - Données personnelles

12-1 Le site www.arlestourisme.com a fait l’objet d’une déclaration à la CNIL n° 1139958 Les informations personnelles communiquées par le client, y compris le numéro, le nom et l’adresse associés à la carte de crédit, sur le Site internet permettent de traiter et exécuter ses commandes et sont cryptée afin d’éviter que celles-ci soient lues lorsqu’elles sont transmises sur Internet. Les informations cryptées sont certifiées par la société OGONE à l'aide de sa solution Quality SSL (http://www.qualityssl.com/) ce qui constitue à l'heure actuelle l'une des meilleures garanties disponibles destinées aux transactions commerciales sécurisées. Le cryptage de toutes les informations personnelles du client, y compris le numéro, le nom et l’adresse associés à la carte de crédit, permet d’éviter que celles-ci soient lues lorsqu’elles sont transmises sur Internet. Conformément à l'article 32 de la Loi Informatique et Libertés du 6 janvier 1978 modifiée par la loi 2004-801 du 6 août 2004, les informations indispensables pour traiter et exécuter les commandes, sont signalées par un astérisque dans les pages du Site. Les autres demandes d’informations appelant une réponse facultative, ou les informations relatives à l’intérêt de l’Utilisateur pour les offres susceptibles de lui être adressées sont destinées à mieux le connaître ainsi qu'à améliorer les services qui lui sont proposés. La survenance d’un impayé au motif d’une utilisation frauduleuse d’une carte bancaire entraînera l’inscription des coordonnées en rapport avec la commande de l’Utilisateur qui est à l’origine de cet impayé au sein d’un fichier incident de paiement mis en ouvre par l’assureur et placé sous sa responsabilité.

12-2 Le client dispose d’un droit d’accès, de modification, de rectification et de suppression des données qui le concernent. Pour l’exercer, il lui suffit de s’adresser à l'Office de Tourisme :Office de Tourisme d’Arles 12 Boulevard Emile Zola - 13200 Arles [email protected]

Article 13 - Assurances - Garanties

L’Office de Tourisme d’Arles a souscrit une assurance responsabilité civile organisateur de voyage auprès de AVIVA et une garantie financière de 30 490 e auprès de l’Association Professionnelle de Solidarité du tourisme - 15, Avenue Carnot - 75017 Paris, afin de couvrir les conséquences de la responsabilité civile professionnelle qu’il pourrait encourir en sa qualité d’organisme local de tourisme autorisé à commercialiser des produits.

Article 14 - Réclamations / Litiges

14-1 Toute réclamation relative à une prestation délivrée sous la responsabilité de l'Office de Tourisme d’Arles dans le cadre de l'exécution du contrat de séjour conclu avec le client doit être faite soit à l'Office de tourisme d’Arles durant le séjour, soit adressée par lettre recommandée avec accusé de réception à l’Office de Tourisme, dans les 10 jours suivants la date de réalisation de la prestation, à l’adresse suivante :Office de tourisme d’Arles 12 Boulevard Emile Zola - 13200 ArlesÀ défaut, aucune réclamation ne sera admise par l’Office de Tourisme.

14-2 En cas de réclamation, l'office de tourisme d’Arles.s'engage à tout mettre en œuvre afin de trouver un accord amiable en vue de résoudre le différend.

14-3 En cas de litiges, les Conditions Générales de vente sont soumises au droit français. Tout litige relatif à leur interprétation et/ou à leur exécution relève des Tribunaux français.

14-4 Après avoir saisi le service (après-vente, après voyage…) et, à défaut de réponse satisfaisante ou en l’absence de réponse dans un délai de 60 jours, le client peut saisir le médiateur du Tourisme et du Voyage, dont les coordonnées et modalités de saisine sont disponibles sur son site : www.mtv.travel.
