2.1 JNTERPRETATION OF THE TEXT
In this by-law:
1) The singular number shall extend tomore than one person or more than onething of the same sort, whenever thecontext admits of such extension;
2) The terms "shall", "should", "must" orany other similar term mean an absoluteobligation;
3) The terms "may", "might", "it ispreferable", "if possible", "preferably","it is absolutely necessary" or any othersimilar term mean an absolute obligationunless the context dictates otherwise in
the opinion of the Committee;
4) The terms "do not", "not appropriate","generally not acceptable", or any othersimilar term mean a prohibition unlessthe context dictates otherwise in the
opinion of the Committee;
5) The infinitive of verbs (such asMaintain, Restore, Preserve ...) implyan absolute obligation;
6) The word "whoever" or "whomever"means any legal person established inthe public or private interest, and allnatural persons;

2.2 RULES OF INTERPRETATION
BETWEEN SPECIFIC PROVISIONS
The following rules apply to this by-law:
1) In the event of a discrepancy betweentwo provisions in this by-law or betweenthis and any other by-law, the specificprovision shall prevail over the generalprovision.
2) When a restriction or prohibitionindicated in this by-law or one of itsprovisions is at variance or in conflictwith any other by-law or any otherprovision of this by-law, the morerestrictive or prohibitive provision shall

2.3.2 Architectural significance(heritage)
The term architectural significance refers notonly to the design value of a given structurebut also encompasses historic and contextualvalue. The greater the architecturalsignificance of the building, the more caremust be given in preserving its definingcharacteristic.

La valeur architecturale ou patrimonialed'un batiment, reliee a la qualite de sondesign ou a son association avec despersonnes ou des evenements historiques, nese limite pas aux batiments les plus anciens.
The architectural significance of a building,whether derived from the quality of itsdesign or from its association with people orevents from the past, is not limited to theoldest and most remarkable few, typicallylabelled "historic".
Trois categories de batiments ont ete etabliesselon leur valeur architecturale afm de
determiner le type d'intervention appropriea chaque batiment. Ces categoriesapparaissent sur les plans des secteurspatrimoniaux.
2.3.3 Batiment

Le secteur patrimonial signifie une zone ausens de I'article 145.16 de la Loi sur I'ame-
nagement et I'urbanisme (L.R.Q., chapitreA-I9).
Three categories of buildings have beenestablished based on different degrees ofarchitectural significance to help determinewhat type of work is appropriate andacceptable. The category of each building isshown on the maps of the character areas.
2.3.3 Building
A structure forming a shelter for persons,animals or property and having a fixed andpermanent roof. The word "Building" shallbe construed as to encompass the words "orpart thereof". The word "Building" refersalso to all construction, including retainingwalls, fences and major landscaping features.
2.3.4 Character area
An area in which the buildings andproperties share similar defining physicalcharacteristics based on topography, streetlayout, history and age, building typology,building siting, and/or architectural style.
A character area means a zone as per section145.16 of the Act Respecting Land UsePlanning and Development (R.S.Q., ChapterA-I9).

3.1.1 L'emission de permis de demolition,de construction, de lotissement, decertificats d'autorisation ou d'oc
cupation est assujettie a I'approbationprealable de plans relatifs a 1'implantation et a 1'architecture des

3.1.1 The issuance of any demolitionpermit, building permit, subdivisionpermit, certificate of authorization oroccupation is subordinated to theprior approval of plans relating to thesite and architecture of the
constructions or the development ofthe land and related work.
3.1.2 The following works are subordinatedto the approval of plans:
- construction of all new buildings aswell as all alterations, repairs andextensions to existing buildings;
- changes to the exterior of abuilding; removing or adding floors,ceilings, partitions, roofs, windows,doors, stairs, balconies, awnings andsigns (this excludes interior orexterior painting, repointing masonry,minor replacement of decayed woodor masonry, or roof repairs, providedthat the replacement is identical to theoriginal work);

3.2 PROCEDURE REQUISE

Le requerant doit soumettre, au Service de laconstruction at de I'amenagement de la villa,das dessins preliminaires pour approbationpreliminaire avant de completer das esquissesddtaillees.

accompagnee de 1'information at dasdocuments suivants :
- the following landscaping work:changes to existing grade, fences,hedges, retaining walls, decks andparking aprons;
- the demolition of any building,garage, shed or a major portion of abuilding.
3.2 REQUIRED PROCEDURE
3.2.1 Application for a permit or acertificate
Concurrently to restricting the requirementsstipulated in the applicable by-law, thefollowing procedure shall apply to theissuance of permits and certificates referredto in section 3.1 of this by-law.
3.2.1.1 Application for approval inprinciple
The applicant shall submit, to the Buildingand Planning Department of the City, apreliminary proposal, for approval inprinciple, before proceeding with the detailedworking drawings.

de plans» complete. Le formulairedoit etre signe par le proprietaire dubdtiment ou etre accompagne d'unelettre d'autorisation signee par leproprietaire.

3. Accurate drawings of the proposedwork. If the proposed work involvesalterations or new construction, submit
drawings (floor plans, elevations,sections, etc.) that clearly andcompletely describe what changes willbe made, what materials will be usedand what the finished appearance willbe. One complete set of the plans (siteplan, architectural, structural andmechanical drawings) folded to 8 1/2" x14" should be submitted. If there are
any structural changes, they must beexplained in detail.

All applications for building permits andcertificates are examined by the Board ofInspections to ensure compliance with theapplicable by-laws.

The Committee will evaluate the applicationin terms of the objectives and criteriaapplicable to the siting and architecture ofthe buildings and landscaping of theproperty, as provided in Chapter 5 of thisBy-law.
After studying the application the Committeewill make its decision as to whether it
recommends approval or refusal of theapplication. If the Committee believes thatit cannot give its approval, it may suggestdesirable modifications to the applicant. Theapplicant may then make a new applicationto the Building and Planning department whowill submit it again to the Committee forfurther review.
